All Things Freelance Writing – Terms of Service Last Updated: 12/04/2025 Welcome to Early Bird by ATFW (“Early Bird,” “we,” “us,” or “our”). By accessing or using our services, communities, newsletters, Slack channels, or curated job lists (collectively, the “Service”), you agree to the following Terms of Service. Please read them carefully. 1. Eligibility You must be at least 18 years old to use Early Bird. By using the Service, you affirm that you meet this requirement. 2. Independent Service; No Affiliation Early Bird is an independent job-curation and community service. We are not affiliated with, endorsed by, or partnered with any companies, clients, brands, or individuals whose job postings or opportunities may appear through our Service. Any third-party names, trademarks, links, or postings remain the property of their respective owners and do not indicate endorsement. 3. Nature of the Service Early Bird aggregates and shares freelance writing and editing opportunities sourced from publicly available posts, social platforms, direct submissions, and other community inputs. We do not represent or act on behalf of any client. We do not negotiate, guarantee, or oversee any working relationships that may arise from opportunities shared in the Service. 4. Vetting Process and Limitations While we vet opportunities to the best of our ability, including reviewing legitimacy indicators and filtering out known scams, we cannot guarantee the accuracy, legitimacy, safety, or reliability of any posting. Opportunities may: Be misrepresented by third parties Change or close without notice Lead to negative or harmful experiences You understand that all opportunities are provided “as-is” with no guarantee. 5. No Guarantees or Endorsements Your use of the Service acknowledges that: We do not endorse any client or company featured in our listings. We do not guarantee any hiring outcomes, compensation, communication quality, conduct, or fulfillment of work agreements. You engage with third parties at your own risk. You are solely responsible for evaluating whether an opportunity is legitimate, appropriate, and aligned with your professional needs. 6. User Responsibilities & Due Diligence You agree to: Conduct independent due diligence before applying, negotiating, or working with any client. Verify payment terms, contracts, scope of work, and company authenticity. Use caution when sharing personal or financial information. Report any suspicious behavior or confirmed scams to us immediately. We encourage users to trust their instincts, ask questions, and prioritize safety. 7. Reporting Scams or Red Flags If you encounter: Nonpayment Fraudulent behavior Misrepresentation Abusive or unethical conduct Red-flag indicators We ask that you notify [email protected] so we can investigate and, when appropriate, remove harmful listings or alert the community. While we take reports seriously, we cannot guarantee that all scammers will be identified or prevented. 8. Payments, Billing & Subscription Terms Access to certain Early Bird offerings (e.g., paid newsletters, Slack channels, white-label lists) requires a subscription fee. By subscribing, you agree that: Your payment method will be charged on a recurring basis until canceled. You are responsible for maintaining accurate billing information. Missed payments may result in service interruption or cancellation. Fees are non-refundable unless stated otherwise in writing. We reserve the right to modify pricing with reasonable notice. 9. No Refunds Due to the nature of digital content and subscription-based services, all payments are final and non-refundable, unless expressly stated otherwise in writing by ATFW. 10. Intellectual Property All Early Bird content—including curated job listings, formatting, copy, messages, branding, and community materials—is the intellectual property of ATFW and may not be: Copied Shared publicly Resold Included in another newsletter, job board, or database Used for commercial or competitive purposes …without express written permission. Violation of this policy may result in removal from the Service without refund. 11. Prohibited Conduct Users may not: Harvest data or use Early Bird listings to build competing job boards, newsletters, or databases Share paid content outside the membership Engage in harassment, spam, or abusive behavior in Early Bird communities Misrepresent themselves or impersonate others Use the Service for unlawful or harmful purposes Violation may lead to immediate removal and denial of future access. 12. Limitations of Liability To the fullest extent permitted by law: ATFW, Early Bird, and their operators are not responsible or liable for any damages, losses, or negative experiences arising from interactions with third-party clients or companies. This includes, but is not limited to: Scams or fraudulent activity Nonpayment or delayed payment Disputes or contract issues Emotional or psychological harm Workload, rate, or project disagreements Unethical or unprofessional conduct You agree to hold ATFW harmless for any outcomes resulting from your engagement with third parties. 13. No Warranty The Service is provided “as-is” and “as-available” with no warranties of any kind. We do not guarantee: Error-free operation Continuous availability Accuracy of listings Protection against harmful or fraudulent third parties Use the Service at your own discretion and risk. 14. Modifications We may update or modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms. 15.
